Resumen
Los derechos económicos, sociales y culturales (DESC) junto con los derechos civiles y políticos (DCP), fueron los primeros derechos en ser reconocidos en el derecho internacional con la Declaración Universal de los Derechos Humanos (DUDH) (1948), un documento con carácter moral en vez de jurídicamente vinculante. No obstante, la protección de ambos tipos de derechos se volvió vinculante con la implementación del Pacto Internacional de Derechos Económicos, Sociales y Culturales (PIDESC), y el Pacto Internacional de Derechos Civiles y Políticos (PIDCP), los cuales se abrieron para firma de los Estados en 1966 y entraron en vigor simultáneamente en 1976.
Aunque fueron declarados interdependientes a pesar de su separación en dos convenios, en realidad los DESC han recibido un trato menos meritorio. A pesar de que se establece que son un factor sine qua non para el disfrute de los DCP, los derechos reconocidos en el PIDESC –al trabajo y a condiciones justas de trabajo; al descanso y el esparcimiento; a formar y pertenecer a sindicatos; a la seguridad social; a la protección de la familia, la maternidad y de los niños y niñas; a un nivel de vida adecuado, incluyendo alimento, vestido y vivienda; a la salud física y mental; a la educación; a la vida científica y cultural- han sido abiertamente desvalorizados en comparación con los derechos civiles y políticos.Citas
