(MIGRATION AND CLIMATE JUSTICE: HU-MAN RIGHTS CHALLENGES)

Abstract

Migration due to climate change is increasing and is projected to continue to grow. Studies show its direct impact on fundamental human rights, such as the right to a dignified life. In this paper we will first reflect on the close relationship between climate change and poverty, as well as the forecasts on its influence on migration. In addition, we will analyze the human rights involved in these migrations from the perspective of climate justice. The need to recognize the human right to clean air and a balanced climate in order to achieve an environmentally just society will be discussed. Finally, the lack of classification as "refugees" for those displaced due to climate change will be addressed, which creates a loophole in current international law and lacks effective protection mechanisms. This omission has significant practical consequences by leaving these vulnerable groups unprotected.
